James Lloyd acted for Teacher L before the Professional Conduct Panel of the Teaching Regulation Agency. Teacher L was the subject of intelligence collected by the National Crime Agency indicating involvement in the distribution of child pornography, with indecent images of children being found on their device upon arrest.
Following a two-day hearing, the PCP accepted submissions that the NCA intelligence was insufficiently reliable and that forensic material gathered by police investigators fell short of proving that images were saved to the teacher’s device with their knowledge.
Following submissions on the teacher’s consumption of pornography which might have explained the presence of such images, personal circumstances and remediation, the PCP recommended to the Secretary of State that the teacher not be prohibited from teaching; a recommendation then followed by the SoS delegate.
