The Defendant faced allegations of assault by penetration using a cucumber and witness intimidation.
The Prosecution led evidence in the form of social media messages between the Defendant and Complainant in which he asked for permission to penetrate her with a cucumber, to which she responded refusing. These were followed by messages in which the Complainant threatened to report the Defendant to the police.
The circumstances of the intimidation were that the Defendant had made repeated attempts to contact the Complainant whilst under investigation and on bail and had transferred money into her account.
