The Defendant was charged with two counts of rape as well as theft and fraud. The allegations of rape were firstly that the complainant had consented to sex but insisted upon using a condom, and secondly that a second incident of sex had not been consented to at all. The Defendant was acquitted of rape, having earlier admitted stealing from the complainant in the same incident, the issue in relation to both rape allegations was consent.
The Defendant was supported during his evidence by an intermediary and the case involved a successful application to question on matters which engaged section 41 YJCEA.
