Expertise

Martyn has experience of prosecuting and defending cases in the Magistrates and Crown Courts. In 2023, Martyn became a specialist defence practitioner, representing clients charged with a range of serious criminal offences and fatal road traffic offences.

Martyn has particular interest in the application of the Criminal Procedures and Investigation Act where issues of a fair trial are hindered by disclosure failings. He is regularly instructed in matters requiring disclosure hearings under s.8 CPIA 1996.

Martyn has 20 years’ experience in the application of Achieving Best Evidence Guidance, and advanced investigative interviews. His experience and knowledge of investigative practice often teases out weakness in the prosecution case and can demonstrate evidential and disclosure failings. Martyn is adept at drafting applications objecting extension of police bail prior to charge, for the exclusion of evidence and abuse of process applications.

Martyn has a busy pro-bono clinic defending veteran service personnel in criminal matters.

R v S [2025] Ipswich Crown Court

Secured an 11-month term if imprisonment for a former police officer charged with Misconduct in Public Office.

R v M [2024] Peterborough Crown Court

Secured the acquittal of a police officer charged with four counts of rape and one count of sexual assault.

R V F [2024] Lincoln Magistrates Court

Successfully represented a serving police officer charged with assault following a complaint of unlawful arrest and unlawful use of force.  Acquitted following a three day trial with expert evidence.

R v D [2024] Medway Youth Court

Successfully represented a youth charged with s.18 GBH.

R v M [2024] Chichester Crown Court

Successfully represented a male charged with three counts s.47 assault (ABH).  Unanimous acquittal on all counts. 

R v B [2024] Lewes Crown Court

Successfully represented a male charged with familial sexual offences.  Unanimous acquittal on all counts.

R v H [2024] Hove Crown Court

Represented D2 in a county lines, class A drugs matter. Secured the defendants acquittal (despite his bad character and s.34 direction after not giving evidence) having argued procedural and police investigation failings. D2 was acquitted, whilst the jury was hung in respect of D1.

R v T [2024] Luton Crown Court

Presented a private prosecution for s.18 GBH.

R v B [2024] Leicester Crown Court

Represented a defendant for conspiring to commit arson.

R v U [2024] Luton Crown Court

Represented a defendant charged with 9 counts of sexual assault on children under 18, three of which were under 13 over an 11-day trial period.

R v W [2024] Court of Appeal | Appeal against conviction

Appeal against conviction following a police officer being convicted of three counts of sexual assault. Appeal grounds arise from errors in law and disclosure failings.

R v P [2024] Woolwich Crown Court

Successfully defended a female charged with S.18 GBH and possession of an offensive weapon following a trial. The defendant was unanimously found not guilty.

R v B [2024] Nottingham Crown Court

Successfully defended a man charged with child neglect and controlling and coercive behavior. Successfully procured a stay in proceedings.

R v S [2023] Peterborough Magistrates Court

Successfully represented da police officer charged with possessing an offensive weapon in a private place after he took his police issue baton home.

R v A [2022], Leicester Crown Court

Represented a defendant charged with the importation of class A drugs.

R v S [2021], St Albans Crown Court

Successful private prosecution of a man charged with dangerous driving.

R v J [2021], Luton Crown Court

Represented the defendant accused of driving whilst under the influence of drugs and failing to stop for police resulting in a lengthy police pursuit.

Prepared the representation of a public service worker charged with sexual touching. The defendant was acquitted on all counts. R v P [2020], Durham Crown Court: Successful defence of a man charged with historic sexual offences whilst in public service.

Martyn has a focus on professional discipline and has worked across a wide range of Tribunals. His 24 years specialist knowledge means he is often sought out to advise on serious and complex issues in regulatory proceedings following criminal, or civil complaints and conduct matters.

Martyn has experience in matters arising within the NMC, GMC, CQC, DVSA and police.  His knowledge of case law across regulators has proved invaluable when advancing legal argument in both the tribunal and appeal tribunals.

In addition to drafting regulation notices, formal responses, statements and requests for information, Martyn regularly gives written advice on procedural and technical issues. Martyn has recently advised on the involvement of a UK Police force in respect of a Netflix documentary.

Martyn often advises both emergency service and civilian driving instructors and has developed a specialist practice in respect of emergency response and military driving.

Martyn is registered on the list of approved driving instructions with the DVSA, Martyn has appeared in the High Court in complex PII applications where family and criminal investigations overlap and has been led in judicial reviews following regulatory proceedings. Martyn is regularly asked to advise on employment matters involving regulated professionals. This includes matters relating to The Equality Act 2010 and matters arising from the Public Interest provisions of the Employment Rights Act.

Police Law

Chief Constable Norfolk Constabulary v PC J

Represented a police officer who engaged in sexual activity on a night out.  Misconduct proceedings were brought following criminal allegations being concluded.

Chief Constable Hertfordshire Police v PC L

Represented a police officer who engaged in sexual activity in the police locker room with a female colleague. When proceedings were instigated against PC L, she reported nonconsensual sexual allegations. Misconduct proceedings were brought following criminal allegations being concluded and both officers were dismissed.

Chief Constable Cambridgeshire Police v PS S

MIPO x 3, S.18 GBH, DPA x 6:  Particularised as a breach of the standards of professional behavior under the Police (Conduct) Regulations 2020 and brought before criminal proceedings on the same facts. Initially scheduled for a 13-day accelerated hearing. Kings Counsel was appointed as legal advisor to the Chair given the complexity of the legal arguments. These included serious corruption by investigating officers, some of which were supported by a whistleblower report to the IOPC.  Successfully argued proceedings be adjourned pending resolution of all criminal matters.

PC M v Chief Constable Bedfordshire Police

In the Police Appeals Tribunal, successfully overturned the finding of dismissal from service for a police officer alleged to have used racist language. Matter remitted to a new hearing.

Chief Constable Nottinghamshire Police v PC F

Represented a police officer in accelerated proceedings following him pleading not guilty to criminal offences. The officer was dismissed. Represented the same officer in criminal proceedings and secured his acquittal on all counts. Legal arguments made in the criminal hearing were later relied upon in an abuse of process application as an appeal in the Police Appeals Tribunal. Successfully applied to the Police Appeals Tribunal to quash the determination of the Chief Constable and have the officer reinstated into service.

Chief Constable Bedfordshire Police v Mr S

Represented a senior police officer alleged to have abused his position by using a religious dating app.  Abuse of Process arguments and ECHR provisions submitted.

Chief Constable Thames Valley Police and PC J (Judicial Review)

Judicial review following the Chief Constable challenging the panel’s decision to impose a final warning.

 

Medical

NMC v P

Dishonesty matters regarding the falsification of patient records.

NMC v D

Interim practice orders relating to a nurse who failed to supervise staff resulting in a child death.

HCPC v F

5 weeks hearing into allegations of sexual touching as a paramedic. Case dismissed.

HCPC v R

Appeal against refusal to register a paramedic following a misconduct finding over 10 years previous.

Martyn regularly appears on behalf of families and interested persons in the Coroners Court. Martyn specialises in Article 2 jury inquests, and Article 2 compliant inquests and general coronial matters where causation issues arise. Martyn is regularly instructed following deaths in custody.

Instructed to represent Police Federation representatives after a police officer walked in front of a train following his detention by Professional Standards Department staff.

Inquest touching the death of TB

Represented one of four midwives in charge of a maternity ward where baby TB died. Worked alongside John Cooper KC and Priya Malhotra (25 Bedford Row).

Inquest touching the death of PP

Represented a triage nurse who failed to properly assess an elderly patient with head injuries in accordance with NICE guidelines.

Represented the family of a young male who took his own life following police intervention.

Represented the family of a male detained at a secure hospital who hung himself whilst in the care of medical professionals.
