Representing Education Professionals

We appear regularly before the Teaching Regulation Agency, the Education Workforce Council, and internal disciplinary hearings within schools, colleges, and academy trusts.

We represent teachers and education professionals at every stage of the regulatory process. Allegations of misconduct in education often place careers on the line. Our barristers have been instructed in the most serious and complex cases, including those involving safeguarding failures, sexual misconduct, abuses of trust, and inappropriate use of physical restraint.

Our barristers have a strong working knowledge of the disciplinary rules and procedures that govern the teaching and education professions which enables them to deliver the very highest standard of service to our clients. They combine their knowledge and skill as advocates to strike the appropriate balance when it comes to presenting arguments based on the evidence of students who are often children, against that of the regulated professional. All our barristers are specially trained in the handling of vulnerable and child witnesses.

University Disciplinary Procedures

Mountford’s barristers are also experienced in advising and representing students at a university level, accused of academic or other serious misconduct. Our barristers are well-versed in university disciplinary procedures and are able to offer advice and experienced representation to students facing action by their university or regulator.

We have particular expertise in handling disciplinary cases with linked criminal investigations including accusations of:

  • Sexual misconduct
  • Physical assault or threats
  • Fraud or dishonesty (including plagiarism)
  • Misuse of AI in academic work
  • Drug use or anti-social behaviour

Exclusions and Parental Appeals

Our barristers are experienced in advising and representing parents and pupils in exclusion appeals, both at the governing board stage and before IRPs. We can assist and advise in cases involving:

  • Fixed-term and permanent exclusions
  • Alleged violent, disruptive, or discriminatory conduct
  • Disproportionate exclusions involving neurodivergent or SEND pupils
  • Failures to follow statutory exclusion guidance

Where appropriate, we also advise on bringing judicial review proceedings against unlawful exclusion decisions or systemic failings by schools and local authorities.

We act in SEND Tribunal appeals on behalf of families in cases including:

  • Education, Health and Care Plans (EHCPs)
  • Refusals to assess or issue EHCPs
  • Disputes over educational provision
  • Unlawful or discriminatory treatment of SEND pupils
  • Disability discrimination claims under the Equality Act 2010
