Not Guilty Verdict: Father Exonerated of Sexual Touching Charges

Martyn Hynes represented a father who was acquitted at Crown Court of allegations of sexual offences against a child.

The case involved a child complainant who gave evidence through pre-recorded cross-examination under section 28 procedures, and a first report to a child witness who was subject to live cross examination. 

The defence faced significant challenges in relation to disclosure and third-party material, requiring detailed legal argument before the court.

At trial, the defence undertook a sensitive cross-examination of the complainants, mindful of their vulnerability and the restrictions imposed by the Youth Justice and Criminal Evidence Act 1999.

Following deliberations, the jury unanimously rejected the prosecution’s case, acquitting the defendant of all charges.

The verdict brings to an end a lengthy investigation and prosecution, with the court noting the complexity of the legal issues raised.
