Yesterday saw the publication of the much-anticipated review by Head of Mountford Chambers, Chris Henley KC into the Criminal Cases Review Commission’s (CCRC) handling of the Andrew Malkinson case.
Andrew was wrongly convicted in 2004 of the violent rape of woman in Salford. There was no DNA evidence linking him to the crime at the time, and his conviction was largely based on identification evidence. He was sentenced to life imprisonment with a minimum term of 7 years but spent 17 years in prison before being released in 2020, plus a further 3 years under probation.
Throughout his trial and incarceration, Andrew Malkinson steadfastly maintained his innocence.
In January 2023, Mountford Chambers’ Edward Henry KC was instructed by APPEAL to represent him at a third Court of Appeal hearing, at which he was fully exonerated for a crime he didn’t commit.
Following the overturning of his conviction, the CCRC took the highly unusual step of announcing that it was appointing Chris Henley KC to conduct a review of their handling of the three applications Mr Malkinson had made to them in 2009, 2018 and 2021. It was at this third application that the case was referred back to the Court of Appeal.
