Martyn Hynes and Anna Wright work together to successfully discontinue a charge of failing to give information relating to the identification of a driver, contrary to section 172(3) of the Road Traffic Act (RTA) 1988 and Schedule 2 to the Road Traffic Offenders Act (RTOA) 1988.
The case involved a defendant who had no knowledge of a collision giving rise to a duty to provide information relating to the identification of the driver. The defence position took issue with the suggestion that the s.172 notice had been issued lawfully and the lack of prosecution disclosure. Martyn and Anna were able to focus on the procedural technicalities of the RTA and RTOA 1988 in order to have the matter discontinued.
