Luna Spada represented the first defendant in a four-handed burglary trial at Inner London Crown Court.
When the defendants were arrested in the vicinity of the offences, they alerted police to CCTV cameras that may have captured the offence location and surrounding areas. Despite this, the police failed to pursue this line of enquiry, leaving the defence without potentially exculpatory evidence.
On the first day of trial, Luna successfully applied to stay the proceedings as an abuse of process, arguing that the failure to pursue reasonable lines of enquiry was so serious that it was no longer possible for the defendants to receive a fair trial.
Luna was instructed and assisted by Helen Ricks of GT Stewart Solicitors.
