Luna Spada Secures Acquittal in Rape Case

Luna Spada secured the acquittal of her client who had been charged with two counts of rape. The jury could not reach a verdict on the remaining counts of assault by penetration and sexual assault. 

The case involved bad character and s41 arguments. The defendant had recorded part of the incident on his phone. The recording was relied upon by the Crown as evidence that the complainant was unconscious at the time of the allegations. The trial lasted 9 days and the jury deliberated for over 12 hours.
