Joseph Sinclair represented the manager of a care home in a prosecution brought by the Care Quality Commission. Six wheelchair-bound service users were taken to the Roadford Lake Activity Centre for a trip in a boat adapted for wheel-chair users. The boat was taken out on the lake with three service-users where it capsized. Two of the service users had been strapped into heavy wheelchairs, were dragged underwater and tragically drowned. The third survived but suffered serious harm. The court found that there had been a wholesale failing to conduct any form of risk assessment.
