Fiona’s client was acquitted of s.18 wounding with intent, following a successful submission of no case to answer.
The case involved an altercation on the street, during which the defendant was swung into a shop window whilst holding a glass bottle. The bottle smashed and was thereafter used towards the complainant. There was previously a hearsay application by the Crown to admit the complainant’s statement and BWV account. This was after the complainant had disengaged and could not be found, which the Crown accepted had nothing to do with the defendant. Fiona successfully opposed the hearsay application.
At trial, the Crown relied largely on CCTV footage of the incident.
At the close of the Crown’s case, Fiona successfully argued that the CCTV evidence was insufficient to demonstrate that the defendant had an intention to cause really serious harm.
