Bianca Brasoveanu’s client faced two charges of driving whilst impaired through drink or drugs. The defendant, having been stopped in Brighton after contravening two one way signs, was breathalysed and provided two positive roadside samples for both drink (albeit under the legal limit) and drugs. He was deemed unfit to drive by the two attending officers following an impairment test.
The trial involved the careful cross-examination of the two police officers who had alleged that the defendant was lying. In fact the officer’s questioning at the scene as shown on body-worn footage was materially different to what reported in their witness statements. The court concluded that the officers’ assessment of the defendant’s impairment was wrong and returned not guilty verdicts.
