Yesterday, 24th January 2023, the Criminal Cases Review Commission (CCRC) referred Andrew Malkinson’s case to the Court of Appeal on the basis of new DNA evidence.
Andrew Malkinson served over 17 years in prison and was released in December 2020. Although his sentence could have allowed for his release after six and a half years, Andy’s consistent protestations that he did not carry out the 2003 rape for which he was convicted caused him to spend an extra decade behind bars.
Andy has been represented by the legal charity, APPEAL and pro bono lawyers from firms Ropes & Gray, Mishcon de Reya and Latham & Watkins.
Edward Henry KC was instructed by Emily Bolton of APPEAL, alongside Max Hardy of 9 Bedford Row.
