Chloe Lennon secured not guilty verdicts for a defendant accused of domestic and non-domestic burglary (in the alternative). The defendant had been found by the homeowner in an outbuilding next to the family home. The outbuilding was used as a home office.
Issues at trial included whether or not the outbuilding constituted a ‘dwelling’ and whether the defendant had the requisite mens rea (intention to steal). The trial also involved legal arguments regarding bad character evidence.
