Ben Hargreaves was instructed by Matt O’Brien of Jonas Roy Bloom Solicitors, Birmingham, in a complex matter of fraudulent trading and assorted Companies Act allegations.
The case concerned a small haulage company that was forced into liquidation in 2014. As a result of poor advice, the company was investigated by the Insolvency Service which led to charges being issued in 2020. Four directors/shadow directors were indicted on allegations that amounted to approximately £700,000.
Ben was instructed to defend the bookkeeper of the company. Through extensive cross examination of the liquidator and the Director of the liquidation company, Ben was able to establish a series of facts that called into question the legitimacy of the advice that had been given and indeed the integrity of the liquidator. After a five week trial at Birmingham Crown Court, all the defendants were acquitted.
