Anthony James Wins Hearsay Argument and Secures Suspended Sentence in Complex Sexual Offence Case Involving Carer and Patient

Anthony James was instructed to represent a mental health support worker who was alleged to have entered into an ongoing sexual relationship with a patient with complex mental health diagnoses. The client pleaded guilty at an early stage to one instance of sexual activity with the patient and unauthorised access of NHS computer records but contested multiple incident counts contrary to section 38 Sexual Offences Act 2003.

On the day of trial, Anthony successfully opposed the Crown’s application to adduce the complainant’s evidence as hearsay on the basis of her unfitness to give evidence.

The client was given a suspended sentence following Anthony’s submissions on the complexity of the basis of sentencing following the ruling on the hearsay application.
